Tree Preservation Orders (TPOs)

The Planning and Development Act of 1963 was provided by the local government for the making of TPOs by the planning authority to preserve the tree on benefits ground.

This act stops tree felling, topping, or intended destruction of trees without the consent of the Planning Authority.

Those trees that are dead, in a state of dying, or considered dangerous, or the cutting of trees comply with the legal obligation to stop the trouble, such TPOs do not need approval from Tree Prevention Orders.

·         You do not need consent to a tree felling that is solely in the yard of your own property.

·         If you are looking for a rental property and need to do a tree felling, then you must have a permission letter from your landlord prior to undertaking any work of felling.

·         If you need a TPO, write to the Planning Department of your Local County Council with a map of the tree’s location and give the reasons for the protection of a tree.

·         If a tree becomes potentially dangerous to society for example has the power lines touch the branches, the ESB can fell the tree- even a tree is TPO.

·         If a TPO tree is felled illegally, contact Gardai or the County council, and the person will be sent to court and charged with a fine.

·         Even if you wish to fell a tree on your own land- you must have a felling license. You are left with some exceptions, such as farming.

·         A tree felling license is mandatory, make sure a tree should be cut down by the license holder service provider- if someone violates the law, the Gardai or the County Council will take legal action against the person.
